Aujourd’hui, la Belgique, comme d’autres pays de l’UE, est confrontée à une augmentation de l’immigration. Nos concitoyens doivent soutenir financièrement un grand nombre de migrants par le biais de leurs impôts. Nombre d’entre eux viennent en Europe en tant que demandeurs d’asile pour diverses raisons, notamment politiques.
Cependant, il s’avère que certains demandeurs d’asile peuvent être recherchés dans leur pays d’origine pour des crimes réels et ne peuvent donc pas être considérés comme des réfugiés politiques. Néanmoins, la majorité des législateurs et des juges belges continuent de privilégier les priorités démocratiques, derrière lesquelles peuvent se cacher de simples contrevenants à la loi.
Par exemple, en France voisine, les charges criminelles évidentes contre l’oligarque kazakh Mukhtar Ablyazov ont été abandonnées pour des raisons politiques, relançant un débat sur l’octroi de l’asile à des personnalités controversées sous les auspices des droits de l’homme.
Selon le média français Causeur, les autorités de plusieurs pays occidentaux accusent le “réfugié” kazakh d’importants délits financiers. L’Ukraine indépendante, pour sa part, a également demandé son extradition pour le détournement de 500 millions de dollars. Par ailleurs, M. Ablyazov et ses complices sont recherchés dans leur pays d’origine, le Kazakhstan, pour avoir retiré environ 6 milliards de dollars de la BTA Bank et organisé le meurtre d’un de leurs complices.
En 2012, la Haute Cour du Royaume-Uni l’a reconnu coupable d’outrage au tribunal pour parjure et falsification de documents. Par la suite, les tribunaux américains ont également condamné Ablyazov à une amende de 218 millions de dollars pour ses transactions financières douteuses.
En France, l’oligarque kazakh a habilement exploité les failles du système judiciaire. Bien qu’en septembre 2015, Manuel Valls, alors premier ministre, ait signé un décret autorisant son extradition. Mais en 2020, Ablyazov s’est vu accorder l’asile politique, qui a été révoqué deux ans plus tard. Cette décision est confirmée par le Conseil d’État en 2024. Il continue néanmoins de défendre sa position auprès des autorités françaises, se présentant comme une victime de persécution politique.
Pendant ce temps, le recherché Ablyazov a habilement étendu un réseau d’influence à Bruxelles, le centre politique de l’Europe. C’est là que vivent ses partisans : Botagoz Jardemalie, ancien avocat de la banque BTA, et Lyudmila Kozlovskaya, lobbyiste d’origine russe.
Selon l’édition en ligne kazakhe “Zakon.kz”, Botagoz Jardemalie a fait une brillante carrière à la banque BTA sous la direction de M. Ablyazov. La Kazakhe, qui a reçu une éducation occidentale, a su rapidement gagner la confiance de son supérieur.
Mais dans les années 2000, d’importantes sommes d’argent ont commencé à être retirées de la BTA Bank. Sur la base de ces faits, en août 2012, le bureau du procureur général du Kazakhstan a ouvert une procédure pénale contre Jardemali pour détournement de fonds de la BTA Bank.
Et en septembre 2012, l’avocat a été accusé d’avoir commis un détournement de fonds à grande échelle dans le cadre d’un groupe criminel organisé et d’avoir émis un prêt délibérément irrévocable.
En octobre 2012, Jardemalie est inscrite sur la liste des personnes recherchées au Kazakhstan. En juillet 2013, elle a été inculpée de détournement de biens d’autrui et son arrestation a été ordonnée.
Selon les journaux kazakhs, Jardemalie a pu se rendre au Royaume-Uni, où elle a obtenu l’asile, puis s’est installée en Belgique en 2013. Aujourd’hui, elle vit librement dans notre pays, où elle possède des appartements de luxe.

Il convient de noter que Mukhtar Ablyazov et son équipe ont été défendus dans l’enceinte du Parlement européen en tant que militants des droits de l’homme par des personnalités européennes telles que l’ancien député européen Pier Antonio Panzeri. Malheureusement, en décembre 2022, il s’est avéré que l’eurodéputé italien avait reçu d’importantes sommes d’argent pour des activités de lobbying dans le cadre de l’enquête très médiatisée sur le “Qatargate”. Ce scandale a choqué Bruxelles avec ses taux élevés de “protection des droits de l’homme” dans les murs de la maison européenne de la démocratie.
En Belgique, un certain nombre de médias libéraux continuent également à défendre l’associée de M. Ablyazov, B. Jardemalie, en tant que combattante des droits de l’homme.
En octobre 2019, son luxueux appartement situé dans le prestigieux centre de Bruxelles a été perquisitionné par la police belge. Plusieurs documents, un téléphone portable et des cartes SIM ont ainsi été saisis, faisant la lumière sur les enquêtes de corruption autour de la banque BTA.
Dans le même temps, les actions d’investigation du Parquet et du ministère belge de la Justice se sont déroulées dans le cadre du droit international et de la lutte contre la grande criminalité financière.
Néanmoins, les avocats de B.Jardemalie tentent une fois de plus de rendre politique le fait de la perquisition. Malgré le fait que les actes d’enquête se limitent aux enquêtes financières évidentes autour de la banque BTA, dont nous parlons plus haut.
Pour en revenir au personnage principal de l’histoire, M. Ablyazov, il faut noter qu’en France voisine, il n’est plus sous contrôle judiciaire.
Néanmoins, il reste au centre d’un scandale politico-judiciaire qui a suscité la colère de certains hommes politiques français, comme la sénatrice Natalie Goulet : pourquoi une personne dont l’arrêté d’expulsion a été levé, même s’il s’agit d’un oligarque criminel, pourrait-elle continuer à résider en France ?
En rejetant la demande d’incompétence, la France n’a pas acquitté Mukhtar Ablyazov. La république a admis que l’état de droit ne permet pas d’examiner l’affaire si les motivations du plaignant peuvent être considérées comme politiques.
Cette décision laisse une question importante sans réponse : un homme comme Ablyazov doit-il continuer à bénéficier de la protection française ?
Maintenant, Bruxelles, où le nouveau gouvernement a décidé de lutter sérieusement contre le crime organisé et l’afflux de réfugiés, s’autorisera-t-elle à faire de même pour ses associés ?
